Terms of Sale

Introduction: These Terms of Sale govern the purchase of photographs ("Photos") from the Marco Antonio Photography, LLC's online gallery ("Gallery"). By making a purchase, you agree to be bound by these Terms.

Purchasing Process:
·         Browse the Gallery to select the desired Photos.
·         Click on the selected Photo(s) to add them to your cart.
·         Proceed to the checkout process, providing accurate billing and shipping information.
·         Complete the payment to finalize the purchase.

Price and Payment:
·         Prices for Photos are as listed in the Gallery and are subject to change without notice.

·         All payments must be made in the currency specified at the time of purchase.

·         Payments are processed securely through the designated payment gateway.

Delivery:
·         Upon successful payment, digital copies of the purchased Photos will be made available for download.

·         For physical prints, delivery times and shipping costs will vary depending on the destination and the size of the order.

·         The photographer is not responsible for any delays caused by third-party delivery services.

Copyright and Usage:
·         The copyright of the Photos remains with the photographer. Purchasing a Photo grants you a non-exclusive, non-transferable license to use the Photo for personal, non-commercial purposes only.

·         You may not reproduce, distribute, or publicly display the Photos for commercial purposes without the explicit permission of the photographer.

Refunds and Exchanges:
·         Due to the digital nature of the product, refunds are generally not provided once a purchase is completed. However, exceptions may be made in cases of technical issues with the download process.

·         For physical prints, refunds or exchanges will be considered for damaged or defective products. Please contact us within 3 days of receiving your order to initiate a return process.

Privacy Policy:
·         Any personal information collected during the purchasing process will be handled in accordance with our Privacy Policy.

Disclaimer:
·         While every effort is made to accurately represent the Photos in the Gallery, variations in color and resolution may occur due to differences in screen calibration and printing processes.

Governing Law:
·         These Terms of Sale shall be governed by and construed in accordance with the laws of the State of Michigan. Any disputes arising out of or relating to these Terms shall be resolved exclusively by the Macomb County District Court.
